3 teens charged for posting sex act on social media

Three male teens from Chesterfield Township were arraigned Tuesday on child sexual abuse charges after allegedly engaging in or distributing pictures of a criminal sexual act involving a 15-year-old girl.

Ryan Anthony Modaffare, Gregory Alan Kwapik and Nicholas Gene Kelly, all 17, appeared in 41A District Court in Shelby Township.

Modaffare is charged with one count of child sexual abusive activity, distributing or promoting, a seven-year felony. Kwapik is charged with one count of third-degree criminal sexual conduct, a 15-year felony. Kelly is charged with one count of third-degree criminal sexual conduct, a 15-year felony and one count of child sexual abusive activity, distributing or promoting, a seven-year felony.

The Macomb County Sheriff’s Office received a report from a L’Anse Creuse High School North student that she discovered a photo online of two students engaging in sexual activity. The photo was posted on one of the student’s social media accounts, police said.

During an investigation, detectives learned that around Thanksgiving four male students went to the home of a 15-year-old female student.

“While visiting the home, two of the male students engaged in a sexual act with the 15-year-old,” the sheriff’s office said in a release Tuesday. “A third male student took a photograph while one of the sexual acts was taking place. That student sent the message to others, and it was eventually posted on one of the student’s Twitter account.”

Modaffare, Kwapik and Kelly each received a $100,000 personal bond. They return to court Jan. 20.
