Michigan man denied bond in retrial
Battle Creek — A Battle Creek man who was granted a new trial after his conviction in the 1995 fire-related deaths of two young brothers in southern Michigan has been denied bond.
The Battle Creek Enquirer reports a judge declined defense attorneys’ motion to release 48-year-old Andrew Babick on Monday. Babick is serving a life sentenced for felony murder.
Babick was granted a new trial in November after the Michigan Innocence Clinic at the University of Michigan Law School argued he was convicted because of faulty science pointing to arson.
Babick’s lawyers argued he is not a threat to society and has a near perfect prison record. An assistant attorney general opposed release.
The judge denied bond while the attorney general office decides whether to appeal the ruling or conduct a new trial.
